Level 3

Level 3 refers to a stage of automated driving in which the car drives completely by itself in certain situations, and the human does not need to watch the road during that time. However, they remain obligated to take back control within a few seconds if the system prompts them to do so.

Cars today can handle varying amounts of driving on their own. Experts divide this into six levels, from 0 to 5. Level 0 means: the human does everything. Level 5 means: the car drives everywhere on its own, a steering wheel would be superfluous. Level 3 lies in between and marks an important boundary. Up to Level 2, the human must constantly keep an eye on the road, even when the car is steering and braking. From Level 3 onward, they are allowed to look away for the first time, though only under tightly defined conditions.

The point where responsibility shifts

Level 3 is less a technical milestone than a legal one. As long as the system is active and functioning properly, the vehicle is driving. If an accident occurs during this time, it is no longer automatically the person behind the wheel who is liable. In Germany, this has been regulated in the Road Traffic Act since 2017. For manufacturers, this is an enormous risk, since they bear the consequences of their own software.

This is precisely why the rollout is progressing so slowly. Tesla calls its system “Full Self-Driving,” but it officially remains Level 2. There, the driver must pay attention at all times and is liable themselves. Mercedes-Benz was the first manufacturer worldwide to receive a Level 3 approval for road traffic, in 2022. The difference sounds small, but legally it is enormous.

A common misconception: Level 3 does not mean that the car drives better than a Level 2 system. It means that the manufacturer is willing to take on responsibility for a clearly defined situation. The underlying technology can even be quite similar.

What the car sees and when it gives up

A Level 3 vehicle combines several types of sensors. Cameras detect lane markings and signs. Radar measures the distance and speed of other vehicles, even in the rain. Lidar scans the surroundings with laser pulses and generates a three-dimensional image. These data streams come together, and a computer calculates a model of the environment from them, and from that, the next steering and braking commands.

What matters is the so-called operational design domain. This refers to the list of conditions under which the system is approved. In the first generation of the Mercedes system, these were highways, dense traffic, and speeds up to 60 kilometers per hour. Outside these limits, the system won’t even switch on.

If the car leaves this domain, it prompts the human to take over. This is known as a takeover request. The driver typically has about ten seconds to respond. If they don’t react, the vehicle brakes in a controlled manner until it comes to a stop. This handover is considered the trickiest part of the entire concept, because distracted people tend, as experience shows, to react sluggishly.

Traffic jams on the highway and headlines from the auto industry

The practical benefit so far lies mainly in traffic jams. Anyone stuck in slow-moving bumper-to-bumper traffic can, with a Level 3 system, look at their phone or watch a film. Sleeping is not allowed, nor is leaving the seat. Newer approvals permit higher speeds, in Germany now up to 95 kilometers per hour.

The term regularly appears in business news whenever manufacturers compete for prestige and approvals. BMW, Honda, and several Chinese providers are working on their own systems. Since 2025, China has significantly expanded approvals for Level 3 testing. Such news moves stock prices, because investors see in it a lead in software and sensor technology.

Important for context: robotaxis from Waymo or Baidu are not Level 3. They drive without a human fallback and are therefore classified as Level 4. Level 3 remains the compromise for private cars, where a human sits behind the wheel and may, in case of doubt, be needed.
