Data Residency

Data Residency refers to the question of in which country the data of a company or public authority is physically stored. Many laws and contracts require that certain data must not leave the home country or the EU.

When you upload a photo to the cloud, it doesn't just vanish into thin air. It ends up on a hard drive in a large building full of computers, a so-called data center. This building stands at a concrete location: in Frankfurt, in Ireland, in Virginia, or in Singapore. Data Residency is the technical term for exactly this question: In which country is the data physically located? For private individuals, this usually doesn't matter. For companies, hospitals, and public authorities, it is a legal requirement they must comply with.

Why the location of a hard drive matters legally

Data is subject to the law of the country in which it is stored. If a patient record is located on a server in Germany, German and European law applies. If the same record is located on a server in Texas, American laws additionally come into play. One example is the US CLOUD Act. Under certain conditions, it obligates US companies to hand over data to authorities, even if that data is located abroad.

For European companies, this is a real problem. The General Data Protection Regulation, or GDPR for short, demands a high level of protection for personal data. Access by foreign intelligence services fits poorly with this. That is why courts have struck down several data transfer agreements with the US in recent years. Companies are responding by keeping data in Europe from the outset.

There is also an economic aspect. Anyone who wants to win public contracts often has to prove that no data leaves the country. For providers of AI services, this has become a selling point. They advertise that requests to their models are processed exclusively in European data centers.

From region selection to the key ring

Large cloud providers divide their data centers into so-called regions, such as "Europe West" or "US East". When setting up storage, you select a region. From that moment on, the data remains technically bound to that location. Backup copies are then also created only within the region, not on another continent.

That alone, however, is rarely enough. Because the support employee who fixes a problem might be sitting in India and can see the data on their screen. Experts call this access, as distinct from mere storage. That is why Data Residency is often combined with encryption: the data is scrambled in such a way that only the customer holds the matching key. Without this key, the content is unreadable for anyone else.

A common misconception is to equate Data Residency with data protection. A server in Germany does not make poorly secured data secure. The location only determines which law applies and who can theoretically demand access. A related but stricter term is data sovereignty: it additionally requires that the operator itself is not subject to any foreign legal system.

Where the term appears in contracts and headlines

Most often, you read about Data Residency in reports about new data centers. When Microsoft, Google, or OpenAI announce a European region, that is usually exactly what it's about. The providers want to win customers who, for legal reasons, could not previously sign up. Projects like Gaia-X, a European cloud initiative, also revolve around this topic.

In everyday life, you encounter the term in the privacy notices of apps and online shops. There, you often find a sentence like: "Your data is processed on servers within the European Union." Schools that use learning platforms must demand this proof from their provider. Several German states have banned—and then re-permitted—software precisely for this reason.

For investors, Data Residency is a cost factor. Building data centers in every major market is expensive and ties up capital for years. At the same time, it opens up markets that would otherwise remain closed. Anyone reading the quarterly figures of cloud corporations will therefore regularly find investments in new regions listed as a separate line item.
