FCC

The FCC is the US agency that regulates radio, telephone, cable, and internet in the United States. It allocates radio frequencies, approves devices, and sets rules for mobile, satellite, and internet providers.

FCC stands for Federal Communications Commission. It is a government agency in the USA that oversees all communications traffic via radio, cable, telephone, and satellite. It was founded in 1934 and operates independently from individual ministries. Its most important task is the allocation of radio frequencies, the invisible channels through which cell phones, radios, and WiFi devices send signals. It also checks whether electronic devices may be sold in the USA at all. It is led by five commissioners, who are nominated by the president and confirmed by the Senate.

Why a frequency authority decides on billions

Radio frequencies are a scarce resource. Two transmitters on the same frequency interfere with each other, so neither works properly. Therefore, someone has to determine who is allowed to use which range. In the USA, that is the FCC. It auctions off frequency blocks to mobile network operators, and these auctions regularly bring in double-digit billions.

For companies, a great deal depends on this. A mobile network operator without suitable frequencies cannot build a fast network. A satellite operator without approval may not beam its signals to Earth. FCC decisions can therefore move the share prices of large corporations. Mergers between telecom or media companies also often require its approval.

A common misunderstanding persists: the FCC is not an internet censorship agency. It can enforce content rules for radio and television, for example against obscenities in freely receivable programming. However, it does not decide on content posted on websites or social networks.

Auctions, licenses, and the FCC mark on the back

The FCC’s work operates through three tools. First, licenses: anyone wanting to broadcast needs a permit for a specific frequency in a specific region. Second, auctions: for sought-after frequencies, companies bid against each other, and the highest bidder wins. Third, rules that apply to everyone, such as limits on interference emissions.

You can imagine the frequency spectrum as a very long piece of land. The FCC divides it into plots, specifies what is allowed on each plot, and sells usage rights for a limited time. Some ranges are deliberately left open for everyone. WiFi and Bluetooth operate in such open zones, which is why a router doesn’t need an individual permit.

New rules are created through a fixed procedure. The agency publishes a proposal, and companies and citizens submit written comments. The five commissioners then vote. Because three of them come from the president’s party, the FCC’s stance often shifts after a change in administration. This was especially visible in the dispute over net neutrality, i.e., the question of whether providers may give certain data streams preferential treatment.

From the phone in your pocket to Starlink’s satellites

The most common contact is inconspicuous. On the back of many devices or in the system info, there’s a small FCC logo with an ID number. It means the device complies with American radio frequency limits. Without this approval, it may not be sold in the USA. In the EU, the CE mark serves a similar role.

In business news, the FCC mainly comes up in connection with three topics: frequency auctions for mobile networks, approvals for satellite networks like Starlink, and mergers in the media and telecom sectors. Rules against automated robocalls also originate from it.

The agency is becoming increasingly relevant to AI topics. For instance, it has ruled that calls using artificially generated voices fall under existing telemarketing bans. However, it is only responsible for the transmission channel, not for the AI itself. A German counterpart is the Bundesnetzagentur, which oversees frequencies and telecommunications domestically.
